Czech 'Trumpist' PM-Elect Refuses to Divest Corporate Holdings During Ethical Dispute

Andrej Babiš, the self-styled tycoon that secured victory in the recent Czech election, has refused to offload his extensive business interests, while asserting he will address a conflict of interest that might block him from taking the role of head of government.

Position on Business Holdings

Babiš, whose political movement emerged victorious in the October vote but did not secure a parliamentary majority, stated in a social media post that he would not sell his Agrofert conglomerate, which operates in farming, food processing, and chemical industries.

“I have repeatedly said I will never sell Agrofert. I have repeatedly said I will resolve the ethical issue in compliance with Czech and European laws,” Babiš commented. “This is not like selling a pastry in a bakeshop.”

Head of State's Demand

The Czech president, Petr Pavel, announced that the 71-year-old political figure must publicly explain how he will remove conflicts of interest stemming from his business activities before being appointed premier.

The Czech constitution “clearly mandates the president to consider the potential occurrence of a conflict of interest and the possibilities for its resolution” when selecting government ministers, Pavel's office explained.

The president “wants it to be clear in what specific way Andrej Babiš will fulfil his constitutional and legal obligations”, the announcement added, noting that Pavel was prepared to designate Babiš as prime minister “immediately” once the issue was settled.

Business Operations and Regulatory Concerns

Babiš's numerous companies, primarily under the Agrofert umbrella, function in the nation and other regional states, receiving millions of euros in domestic and European farming and other grants, as well as public contracts.

Under Czech law, government ministers cannot receiving public aid or agreements. The ethics organization Transparency International has stated that to avoid a ethical breach, Babiš must either sell, decline public contracts, or not enter public office.

Previous Term and Current Intentions

Babiš said he would “abide by the laws” if appointed as premier, but declined to explain how in beforehand because the matter was “an highly personal and personal matter for me, and the media will always criticise me anyway”.

During his first term as prime minister, from 2017 to 2021, Babiš faced multiple court cases and an European inquiry over possible ethical issues. He temporarily moved his assets into fiduciary arrangements, while keeping certain control over them.
